Though given Sega’s dogshit legal skills with regards to Archie and Ken Penders, they might as well just ignore it.
Ken Penders didn’t actually win the lawsuit, they settled out of court, he won publishing rights to some of the Archie Comics. He does not actually own Scourge The Hedgehog, Sally Acorn, or any other Sonic character, the reason Sega doesn’t use those characters is because Sega doesn’t want them used.
I know Penders didn’t win the lawsuit, it was moreso Sega and Archie’s incompetence when it came to organizing rights for character creation and archving important legal documents pertaining to the ownership of licensed IP that allowed Penders and other Archie Sonic writers to walk off with their legally dubious OCs.
